My employer is breaking the law???
I work as a waiter's largest restaurant string in California. Below IRS regulations, we as the tip of the staff members are vital for 100% of our advice. In recent months, administrators are asking staff to meet the point, if not exceed 12% of our total sales per day, informed of our advice. In an economy in quandary, most of the time, we are not at least 12% of our sales. Let me point out also tip other staff members, and the IRS requires that 100% of what we are seeing in our actaully own pockets. My directors are threatening to fire employees who are not meeting this guideline 12% and are telling employees to seek further if not taking money! This may not be legal, does it?
There have been suitcases where the IRS has made employers pay taxes on tips that employees not presented. Below is such a case, Fior d'Italia, v. United States.
